What Are Citizens Getting From Public Agencies?
All too often we hear of government programs that cause inefficient and wasteful allocation of goods and resources. Consider the example of the Australian government home insulation program (HIP), which was designed to prop up business in the wake of the global financial crisis, providing rebates to insulate the ceilings of 2.2 million houses at a cost of (AUS) $ 2.7 billion. As well as claiming that the scheme would create jobs, the government sought to boost its "green" credentials, insisting that home energy bills would be cut dramatically. Countless problems plagued the HIP; houses caught fire, thousands of cases of fraud were claimed, numerous installation companies went bankrupt, and a number of deaths and injuries occurred (despite multiple safety warnings from regulatory agencies). A lack of effectiveness in the program design, administration, and delivery arrangements and a poor management structure for dealing with the risks associated with a rapid program rollout (along with making the program instantly available to millions of household owners and suppliers without first piloting the offering ) were cited by an independent review as the main contributors to the failure of the HIP program. After sustained media pressure, and in an effort to exercise damage control, the program was scrapped in early 2010.

DAC Report – Government Subsidies Are Top Downfalls for Truck Drivers

Training standards for new CDL drivers have reached a higher concern for the FMCSA in recent years. Social media has played a major role in highlighting the further needs for safer commercial vehicle driver training.

Union or Non-Union, the two major attacks on all truck drivers is the DAC report and the government policies that deliberately oversupply drivers into the industry. Government subsidies and grants provided to training motor carriers are actually driving good drivers out of the industry as fast as they come in.

Training companies can receive tens of thousands of government dollars to provide on-the-job training per student. Once trained, these new drivers are paid as low as .23 to .27 cents per mile: a non-living wage. Furthermore, CDL schools should have a new curriculum regarding who can be taught.

Many schools continue to accept any student that walks through the door; even those with felonies, DUI’s and other such violations that absolutely ensures that no motor carrier will hire them.

Training is both prolific and expensive, however it is not realistic or comprehensive enough in light of real driving demands and the unrealistic measures. DAC, which stands for “Drive-A-Check,” has become nothing more than a retaliation tool that carriers use against drivers.

As one driver states: “DAC is being used to beat to death greenhorns.” It is noted as such a serious problem within the industry that the Workers’ Counsel even formed the DAC Report Class Action Registry.

Two of the best solutions to entry-level driver training is to close down the DAC Services and to take away the government policies regarding grant money and subsidies to motor carriers. These subsidies should be dismissed completely for all motor carriers and CDL schools.

As an example, one trucking company that trains students has five training facilities. Each month they run about 80 students through each facility for a total of 400 per month and 4,800 per year. Yet, they only have 3,125 available trucks. The reason companies give for this is to compensate for the high turnover rate within the industry; those new drivers that statistics show will quit the job within the first six months.

However, when you multiply 4,800 students by an average of $3,400 per student, you reach a figure of $16,320,000 per year; add the additional 18% to 25% interest placed on the loan and another few million of dollars come into play.

In the beginning, both began with good intentions, but have resulted in bad consequences by interfering with the industry’s driver supply and demand. These subsidies, along with the DAC report, have actually created an oversupply of drivers, non-living low wages and continue to fuel a revolving door of drivers.

John Locke’s Second Treatise of Government and the Limits of Our Implicit Consent to Government

In John Locke’s Second Treatise of Government, his entire political philosophy hinges upon the fact that humans are moral equals and thus unable to legitimately govern or impose rules upon another without that other person’s consent. For Locke, the perfect answer to this is entitled express consent. According to Locke, “[n]o body doubts but an express consent, of any man entering into any society, makes him a perfect member of that society, a subject of that government” (Locke 64). Express consent is the perfect way to bind the original members together. This however, raises many difficulties for Locke once critics begin to question how someone can consent to a system of government for which they never expressly consented or gave their agreement; simply stated, they were not the founding members, and thus how can it be argued that they are legitimately ruled by the government? Locke’s rebuttal is tacit consent, a method by which any man “that hath any possessions, or enjoyment, of any part of the dominions of any government, doth thereby give his tacit consent” to be ruled by that government (64). Though this seems to be a sound remedy, further holes can be exposed using a hypothetical, but very plausible, situation to demonstrate. The situation is as outlined below:

An adult citizen who was born in this country (and thus never had to take an oath of citizenship) was disgruntled about the lack of funding for education and began protesting on the steps of a government building. Shortly thereafter, a police officer confronts her and informs her that she has broken the law by protesting within 100 feet of the public building without a permit. He attempts to arrest her but she explains that, as a moral equal, she never consented to join the body politic and thus these laws do not apply to her.

Using the above situation, it becomes simple to apply Locke’s response, tacit consent. However, to fully understand this issue, a counter argument by the protestor must be offered and tacit consent must be adjusted to include her arguments such that she is still bound by the national law.

Assuming that the police officer is an educated man and familiar with his political philosophy, specializing in Lockean philosophy, his response would be a classic example of tacit consent applied to life. He would start with the beginning – at one point in time, a group of citizens joined together to form a body politic and institute a government on the land now called the United States of America. However much the people of America may appreciate the need to switch over to alternate energy sources, it cannot become a reality unless the federal, state and local governments work in conjunction to make several mandatory programs. These include that all homes that are under construction or being remodeled must use alternative energy sources. Ultimately a time would come when all homes as well as corporate buildings would use alternate energies for 100% of their energy needs. The other important mandate that is expected from the government is that all new vehicles built in this nation must be hybrid and be powered by hydrogen fuel cells by the year 2020. 

Such mandatory compliance from the citizens would only see the light of the day if the government enforced laws on construction and utility providers. The government would have to pay equal attention to the several sectors within alternate energy industry: in the generation of different types of energies including solar, wind, hydroelectric, biofuel, geothermal and atomic; its storage systems like more efficient batteries and hydrogen fuel cells; and, development of infrastructures. All these efforts should ultimately result in more affordable prices and easier usability of alternate energies. Yet, we would remain where we are now, without government help.

MOD's Accelerated Job Losses – Is the UK Government Risking Its Support to the Frontline Forces?

Like all government departments in the UK, the Ministry of Defense (MOD) has had its share of budget cuts. In order to reduce costs, the MOD has resorted to reduction in front line staff, delaying in development of its weapons, and mass redundancies with its so called softer areas – its civilian staff.

MOD's target for reduction in its civilian staff over the next 3 years is 25,000 employees. As part of this staff reduction program, MOD was hoping to make about 4,000 staff redundant this year. The MOD was pleasantly surprised when it received 8,000 voluntary applications for redundancies. Combination of a generous redundancy package and the fact that many of the civil servants are now beginning to accept the reality and want to move on, has doubled the expected take up. The MOD has now decided not to slow down and make 8,000 jobs redundant instead of the original budgeted 4,000 redundancies this year. While this inevitably helps the MOD to meet its targeted number of 25,000 in the next three years, a sudden surge in the number of redundancies and staff losses puts MOD in a tricky situation.

As majority of the job losses are in the back-offices, front line officers and heads of battalions in the armed services worry that some of the critical back-office functions may become understaffed. The unions have similar claims. They insist that it was only in May 2011, that the MOD assured that they would not increase redundancies from their target of 4,000 as it can impact their capability to support the front line forces. The latest u-turn by the MOD accepting 8,000 redundancy applications has taken front line forces and the unions by surprise.

To be fair to the MOD, it has insisted that the job losses would be carefully managed to ensure that none of the critical areas of support would be under-resourced. However, several union members have criticized the department saying that it lost its ability to cope with the financial pressures it is facing. They label is as "short-termism gone mad".

The MOD will always continue to be under close scrutiny by the general public. Criticism in the past such as inadequate support leading to deaths and injuries of front line staff has not helped the MOD. While the war in Iraq is over, dangers of escalation in Afghanistan and Libya remains a genuine concern for the MOD.

It will always be nice to have well-oiled defense machinery and removal of extra fat and overheads is always a welcome move. With 25,000 redundancies in the support staff – has MOD pushed this a bit too far? – Only time will tell.

Protecting Government Benefits With Special Needs Trusts

A special needs trust (SNT) is a trust designed to supplement the needs of an individual whose necessary medical or living expenses are paid through programs such as Medicaid or SSI. Because these programs are "means tested" – based in part on income – an SNT enables the beneficiary to continue receiving aid despite an increase in income or assets. In general, the excess funds are placed into the SNT which then pays for the beneficiary's supplemental needs such as recreation and consumer goods not otherwise covered by government benefits. Here are a few examples:

Divorce and the disabled child . Disabled children who receive SSI risk a reduction or termination of benefits when one parent is required to pay child support. Receipt of child support can reduce SSI benefits by one third for children under age 18 and dollar for dollar for children age 18 and older. Instead of the funds being transferred outright, the child support can be placed into an SNT which diverts the income away from the child. Because SSI provides for food, shelter and utility expenses, the SNT can pay for other life enhancing benefits such as vacations, electronics or specialized vehicles – all while maintaining the child's entitlement to government benefits.

Personal Injury Settlements . Personal injury settlements are designed in part, to cover the individual's future medical expenses and needs. A portion of the settlement may also be awarded as a "punishment" for the defendant's wrongful conduct. However, disabled individuals receiving SSI and Medicaid risk disqualification upon receipt of a lump sum settlement. In addition, Medicaid may have a right of recovery against the portion of settlement earmarked for medical care. To aviod disqualification from these important government benefits, an SNT can be established to accept the net settlement proceeds. The money placed in the SNT can then be used to purchase supplemental goods and services that enhance, rather than replace government benefits. Similar to the example above, SNT funds can be used to plan vacations for the disabled individual, to purchase specially equipped vehicles and to provide other comforts including consumer goods or beauty services.

Third Party SNTs . A third party special needs trust involves the same concepts as outlined above. However, the SNT is funded with the assets of a third party for the benefit of the disabled individual. For example, a grandparent, friend or other indvidual who is not legally responsible for the beneficiary can establist an SNT to pay for the supplemental needs of another. In addition to helping the disabled individual, a grantor who funds a third party SNT for the benefit of their disabled child may be able to partially avoid the five year lookback period for their own Medicaid qualification.
